Peeler v. Rocky Mountain Log Homes Canada, Inc.
The Supreme Court affirmed the judgment of the district court granting Defendants’ motion to compel arbitration and dismiss the case, holding that the district court did not erroneously compel arbitration.Plaintiff entered into a construction contract that contained an arbitration agreement. Plaintiff later filed a complaint against Defendants, asserting claims for breach of contract, negligence, and other torts. Defendants filed a motion to compel arbitration and dismiss. The Supreme Court granted the motion to compel arbitration and dismissed the action. The Supreme Court affirmed, holding that the district court did not err (1) in concluding that the arbitration agreement required arbitration of matters within its scope rather than merely authorizing it as a matter of discretion upon timely demand; (2) in failing to conclude that Defendants equitably waived the right to arbitrate; (3) in compelling arbitration without consideration of Plaintiff’s proposed declaratory judgment claim challenging the validity of the arbitration agreement; (4) in concluding that Plaintiff’s asserted non-contract claims were subject to arbitration; and (5) in failing to conclude that, as a non-party to the agreement, one defendant lacked standing to enforce the arbitration agreement. Anderson v. John Deere & Co.
The Supreme Court affirmed the district court’s denial of Appellants’ motion to compel arbitration of claims brought by Appellee, holding that the district court did not err in denying Appellants’ motion to compel arbitration.At issue in this case was a dealership agreement containing an arbitration clause. The agreement was signed by Frontline Ag, LLC and John Deere Company. Appellee owned an interest in Frontline. The dealer agreement contained an arbitration clause requiring arbitration of disputes between Deere and Frontline, the dealer. Appellee eventually filed this action against Deere alleging, inter alia, tortious interference with contract. Deere moved to stay the proceedings and compel arbitration. The district court denied the motion to compel arbitration, reasoning that Appellee never agreed to arbitrate his claims against Deere and that the dealer agreement only required arbitration of disputes between Deere and Frontline. The Supreme Court affirmed, holding that the arbitration clause did not incorporate Appellee’s personal damage claims within its definition of disputes subject to mandatory arbitration. Colorow Health Care, LLC v. Fischer
When Charlotte Fischer moved into a nursing home, she received an admissions packet full of forms. Among them was an agreement that compelled arbitration of certain legal disputes. The Health Care Availability Act (“HCAA” or “Act”) required such agreements contain a four-paragraph notice in a certain font size and in bold-faced type. Charlotte’s agreement included the required language in a statutorily permissible font size, but it was not printed in bold. Charlotte’s daughter signed the agreement on Charlotte’s behalf. After Charlotte died, her family initiated a wrongful death action against the health care facility in court. Citing the agreement, the health care facility moved to compel arbitration out of court. The trial court denied the motion, and the court of appeals affirmed, determining the arbitration agreement was void because it did not strictly comply with the HCAA. At issue was whether the Act required strict or substantial compliance. The Colorado Supreme Court held "substantial:" the agreement at issue her substantially complied with the formatting requirements of the law, notwithstanding the lack of bold type. Cullinane v. Beverly Enterprises – Nebraska, Inc.
The Supreme Court affirmed the denial of Appellant’s motion to dismiss or stay proceedings and compel arbitration, holding that the issue of whether the arbitration agreement in this case was enforceable was properly decided by the district court and not an arbitrator.Thomas Cullinane, as special administrator for the estate of his mother, Helen Cullinane, filed a wrongful death action against Appellant, Beverly Enterprises - Nebraska, Inc., doing business as Golden LivingCenter - Valhaven (GLCV). GLCV filed a motion to dismiss or stay proceedings and compel arbitration in accordance with the terms of a written arbitration agreement between GLCV and Helen. GLCV asserted that Eugene Cullinane, Helen’s husband, while acting as Helen’s attorney in fact, signed the agreement when he and Helen were admitted to the facility. The district court found that Eugene’s execution of the arbitration agreement could not be binding upon Helen, nor her estate, and thus dismissed GLCV’s motion. The Supreme Court affirmed, holding that the district court did not err in determining that the arbitration agreement was not binding upon Helen or her estate. View "Cullinane v. Colorow Health Care, LLC v. Fischer
Charlotte Fischer was moved into a nursing home; after she died, her family initiated a wrongful death action against the health care facility in court. Citing a clause in the admissions agreement, the health care facility moved to compel arbitration out of court. The trial court denied the motion, and the court of appeals affirmed, determining the arbitration agreement was void because it did not strictly comply with the Health Care Availability Act ("HCAA"). In this case, the Colorado Supreme Court considered whether section 13-64-403, C.R.S. (2017) of the HCAA, the provision governing arbitration agreements, required strict or substantial compliance. The HCAA required that such agreements contain a four-paragraph notice in a certain font size and in bold-faced type. Charlotte’s agreement included the required language in a statutorily permissible font size, but it was not printed in bold. Charlotte’s daughter signed the agreement on Charlotte’s behalf. The Supreme Court held the Act demanded only substantial compliance. Furthermore, the Court concluded the agreement here substantially complied with the formatting requirements of section 13-64-403, notwithstanding its lack of bold-faced type. Arch Coal, Inc. v. Lemon
The Supreme Court upheld the Workers’ Compensation Board of Review’s finding that, based on the preponderance of the evidence, Jimmie Lemon’s injury was work related.Jimmie Lemon filed a workers’ compensation claim claiming that his low back injury occurred in the course of and resulting from his employment with Arch Coal, Inc. The Office of Judges found the claim compensable and designated Lemon’s compensable condition as a herniated disc. The Board of Review affirmed. The Supreme Court reversed and remanded the case with directions that the claim be rejected, concluding that Lemon’s injury was not work-related. Upon reconsideration, the Supreme Court upheld the prior administrative finding that Lemon’s injury was work-related. Accordingly, the Court affirmed the decision of the Board of Review and remanded with directions to reinstate the decisions of the Office of judges and the Board of Review that Lemon’s claim was compensable. AMFM, LLC v. Shanklin
A durable power of attorney (DPOA) provided an adult daughter with the authority to enter into an arbitration agreement with a nursing home on her mother’s behalf.Lena Nelson executed a DPOA that named her son as her attorney-in-fact. The DPOA stated that if her son could not serve as such, Nelson’s daughter, Kimberly Shanklin, should be Nelson’s attorney-in-fact. Nelson was later transferred to Hillcrest Nursing Home. Shanklin signed all of the admission documents, including an arbitration agreement. Approximately one month after leaving the nursing home, Nelson died. Shanklin, on behalf of her mother’s estate, filed this suit against Hillcrest. Hillcrest, in response, filed a motion to dismiss and to compel arbitration. Shanklin argued that the arbitration agreement was unenforceable because she did not have the actual authority to enter into the agreement on Nelson’s behalf because she was the “alternate” DPOA. The circuit court agreed and denied the motion to dismiss and to compel arbitration. The Supreme Court reversed, holding (1) Shanklin had the authority to enter into the arbitration agreement with Hillcrest; and (2) under the plain language of W.Va. Code 39B-1-119(c), Hillcrest was permitted to rely on Shanklin’s authority as Nelson’s DPOA when Shanklin signed the arbitration agreement on Nelson’s behalf. View "AMFM, LLC v. Keyes v. Dollar General Corp.
Rebecca Keyes, a former employee of Dollar General, filed suit against Dollar General Corporation; DG Mize, LLC; Dolgencorp, LLC d/b/a Dollar General Store #11775 (collectively “Dollar General”), alleging counts of malicious prosecution, infliction of emotional distress, defamation, false imprisonment, fraud, deceit, and misrepresentation, after Dollar General filed a criminal affidavit against Keyes in the Municipal Court of Mize, Mississippi, causing Keyes to be arrested for embezzlement. Keyes performed a "cash reload" to a money network card for $500.00, which did not go through properly. Rebecca Keyes informed her manager of the problem and placed the receipt on the office desk. Rebecca was told not to worry about the problem and that it would be fixed. On June 2, 2015, Rebecca Keyes was arrested for embezzlement. Thereafter, on July 16, 2015, Rebecca was found not guilty of the charges. Keyes moved to have the charges dismissed for failure of a Dollar General representative to appear and prosecute the claims. Her motion was granted. She then filed the instant lawsuit. Dollar General filed a motion to dismiss and compel arbitration, which was granted by the Circuit Court of Smith County. With the exception of the defamation claim, the Mississippi Supreme Court found the trial court erred in compelling arbitration, for Keyes’s remaining claims were not within the scope of the arbitration agreement. The Court affirmed the trial court’s order as to the defamation claim and reversed its judgment as to the remaining claims, remanding for further proceedings. View "Keyes v.
